Apple's patent violations may be justified, says German court

Motorola may resolve its 3G ‘push email' patent battle with Apple by licensing patents in return for 2.25% of Apple's sales, following rulings by a German court. February 3 saw a ruling in favour of Motorola quickly succeeded by Apple's successful appeal for suspension. It's now established that Apple is in violation of the patents, but may not be at fault as it accuses Motorola of non-compliance with FRAND antitrust regulations, due to alleged refusals to license the 'industry standard' patents on reasonable terms. Motorola is now liable for damages for the EUR100m bond posted against Apple after the initial victory, which took iPhones and other devices off sale during the hours between the rulings.
